Scope of This Agreement

Description
To the purposes described herein, “User” means

  • (a) each customer using PCPrivacyTool Software and its services;
  • (b) any person or organization transmitting e-mails, files or other data into a network owned/managed by PCPrivacyTool.
  • (c) any person or trading organization connected to a URL resource owned or managed by PCPrivacyTool; and
  • (d) any person or organization contacting PCPrivacyTool by means of any telecommunication network.

“PCPrivacyTool” means PCPrivacyTool, its successors and assigns.
This agreement, entered into between the User and PCPrivacyTool describes the rights and liabilities concerning use, download and storage of any PCPrivacyTool site, including but not limited to, the sending of e-mails to the PCPrivacyTool network, and the use of any services from PCPrivacyTool that authorize PCPrivacyTool to charge your credit or debit card, checking account and/or telephone invoice. These Services allow Users to interact through their personal computers.

Acceptance of the Agreement

The attempt to purchase, download or use PCPrivacyTool services in any other way will be construed as Your acceptance of this Agreement.

Service Description

A. Consumer Service:

Users are entitled to transmit information to several financial and telecommunication networks to settle the corresponding payments. Users must be at least 18 years old in order to obtain the subscription and make use of the resources of this website.

UPON CONFORMITY TO THIS AGREEMENT AND/OR TO ANY OTHER AGREEMENT CONCERNING THE USE OF THE SERVICES AND/OR ANY SPECIFIC RESOURCE OF PCPrivacyTool, USERS MUST SUBMIT THE DATA REQUIRED BY THIS AGREEMENT AND ACCEPT ITS TERMS AND CONDITIONS.

Users must enter a valid e-mail address. Should any of the required fields remain empty, it may be construed that the user has waived certain rights set forth in this Agreement.

1) Authorization to Charge Credit/Debit Card

The billing address provided, as well as the CVV2 code at the back of your credit card must be the same as the billing address of the credit. Should the billing addresses differ, your order will not be processed. In case your credit card is declined, you will receive a notification through e-mail. The submission of your credit card details authorizes us to contact your issuing bank for settling (a) financial transaction(s).

After PCPrivacyTool has approved or declined your purchase, you agree that PCPrivacyTool has fully performed in compliance with the terms and conditions of this Agreement. If you choose to cancel your order, you must contact us at pcprivacytool.com. You can contact our Customer Support at support@pcprivacytool.com

Should there be errors in the User’s account, including wrong amount or non-authorized transaction, the User must contact us immediately upon detection of the errors, and within the time periods stated below. If duly notified, PCPrivacyTool, in its sole discretion, may issue a refund:
United States Issued Bank Cards: within 60 days after the completion of the transaction.
International Issued Bank Cards: within 60 days after the completion of the transaction.

2) Authorization for ACH debit

The submission of your credit card details authorizes us to contact your issuing bank for settling (a) financial transaction(s).

The submission of the User’s checking account details to PCPrivacyTool authorizes PCPrivacyTool to contact the User’s depository bank for settling (a) financial transaction(s). After PCPrivacyTool has approved or declined the purchase, the User agrees that PCPrivacyTool has fully performed in compliance with the terms and conditions of this Agreement.

If the User chooses to cancel his/her order, he/she must contact us at pcprivacytool.com. You can contact our Customer Support at support@pcprivacytool.com.

Should there be errors in the User’s account, including wrong amount or non-authorized transaction, the User must contact us immediately. In case a non-authorized transaction is not reported within 60 days after a financial statement is received, the User’s liability shall not exceed the amount of the non-authorized transactions carried out during the term comprised between the expiration of the 60 day period and the notification of PCPrivacyTool. If duly notified, PCPrivacyTool, in its sole discretion, may issue a refund to the User’s checking account. Copyright

A. Online Copyright Infringement Liability Limitation Act

The company is entitled to remove the accounts of those users who infringe other people’s copyrights.

PCPrivacyTool and its affiliates comply with the legal provisions regarding copyright. If you think that PCPrivacyTool contains hyperlinks to a site infringing your copyright, please send us the information below to support@pcprivacytool.com:

  • an account of the copyrighted work infringed;
  • the location of the work on the Web; and
  • your address, telephone number and e-mail.

Also provide us with your signature, or with the signature of the person authorized to act on behalf of the copyright owner, as well as with a written statement asserting that the information you provided is truthful, and that you are the copyright holder or the person authorized to act on behalf of the copyright holder.

PCPrivacyTool shall, in the appropriate circumstances and at its sole discretion, disable access to the service.

In order to access some interactive services, a username and a password must be entered. The User shall be responsible for the confidentiality and security of his/her username and password, and for any activity carried out under your login. The User must immediately notify PCPrivacyTool about any non-authorized use of his/her username or password or any security infringement, and also make sure to sign out of his/her account. PCPrivacyTool shall not be responsible for any loss or damages resulting from non-compliance with this section. Any account may be terminated by PCPrivacyTool's sole discretion on the basis of performance of activities deemed to be fraudulent, offensive or illegal. Furthermore, PCPrivacyTool may resort to appropriate law enforcement agencies.

Behavior of the User

The user understands that all the content, encompassing information, texts, software, music, sounds, graphics, movies, videos, messages and other materials is the property of PCPrivacyTool or its content suppliers; and that it is protected by the United States and International copyright laws. PCPrivacyTool has the exclusive ownership of all the content compiled on this site, and such compilation is protected by U.S. and international copyright laws. PCPrivacyTool owns all software used on this site, which is protected by United States and international copyright laws.

The User shall not use any of PCPrivacyTool Services in order to:

  • upload, post, email, send out, or else provide any Content that may be illegal, harmful, threatening, insulting, or annoying;
  • harm minors in any manner;
  • assume the character of any person or entity;
  • forge headers or else change identifiers in order to conceal the origin of any Content sent out;
  • upload, post, email, send out, or else provide any Content infringing any patent, trademark, trade secret, copyright or other intellectual property right;
  • upload, post, email, send out, or else provide any unwanted or non-authorized advertising, promotional materials, spam or material containing software viruses;
  • interrupt the normal flow of information or else interfere with any data communications;
  • deliberately or inadvertently infringe any applicable local, state, national or international law, including, but not limited to, regulations promulgated by SEC, NASDAQ, FTC, FBI, or other federal or state agency;
  • stalk, or else harass other people; or
  • compile, or store personal data about other users, without first establishing and enforcing a privacy policy with at least as much protections as the PCPrivacyTool Privacy Policy.

Software

PCPrivacyTool is the copyright owner of all content and software that is made available to view and/or download through PCPrivacyTool Site/Service/Software, excluding any content and software which may be made available by end-users through a resource not controlled by PCPrivacyTool. Such protected material is governed by copyright laws and international treaty provisions. Your use of the Site/Service/Software shall be subject to this Agreement, as well as the agreement connected to any PCPrivacyTool Service. Acceptance of such agreements is an essential condition for the further installation and use of any Site/Service/Software.
The Software is made available for download exclusively for end users. Reproduction or redistribution of the Software in violation of this License Agreement is expressly forbidden by law, and may result in severe civil and criminal penalties. Infringers will be prosecuted to the maximum possible extent.

NOTWITHSTANDING THE FOREGOING, COPYING OR REPRODUCTION OF THE CONTENT OR SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPLICITLY FORBIDDEN. The user agrees that the Site/Service/Software, and any enclosed documentation and/or technical information, shall be governed by USA export restrictions. Therefore, the User shall not export or re-export the Site/Service/Software, directly or indirectly, to any countries that are subject to such restrictions.

Liability disclaimer

THIS SITE IS PROVIDED BY PCPrivacyTool ON AN "AS IS" AND "AS AVAILABLE" BASIS. PCPrivacyTool DOES NOT GUARANTEE, EITHER IN EXPRESS OR IMPLIED WAY, THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS MADE AVAILABLE IN THIS SITE. THE USER EXPLICITLY ACCEPTS THAT THE USE OF THIS SITE IS AT HIS/HER SOLE RISK.

TO THE FULL EXTENT PERMITTED UNDER APPLICABLE LAW, PCPrivacyTool DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PCPrivacyTool DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAILS SENT FROM PCPrivacyTool ARE SAFE FROM VIRUSES OR OTHER THREATENING ELEMENTS. PCPrivacyTool SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

SHOULD THE USER BE DISSATISFIED WITH ANY SECTION OF THE PCPrivacyTool SITES/SERVICE/SOFTWARE, OR WITH ANY OF THE TERMS HEREIN, HIS/HER SOLE REMEDY IS TERMINATION OF THE USE OF PCPrivacyTool SITES/SERVICE/SOFTWARE.

Termination/ Access Control

PCPrivacyTool is entitled to deny the User access to the PCPrivacyTool Site/Service/Software, either totally or partially, without any prior notice.

PCPrivacyTool is also entitled to terminate or cancel your access to the PCPrivacyTool Site/Service/Software due to inactivity, defined as the failure to log in for an extended period of time, as determined by PCPrivacyTool.

Other

PCPrivacyTool can supply links to the sites of affiliated companies and other businesses.
The offers of these companies, or the content of their Web pages, are not under our responsibility. Likewise, PCPrivacyTool shall not be liable for the actions, products, and content of any other third parties. You should carefully review their privacy policy and other conditions of use.

General

The User agrees that these terms and conditions shall be governed by the laws of the state of Nevada, as well as any conflict that might arise between the User and PCPrivacyTool or its affiliates.

Compliance of this agreement by PCPrivacyTool is ruled by the laws and legal process in force. No section herein shall be deemed as a waiver by PCPrivacyTool to compliance with governmental, court and law enforcement inquiries about the activities performed by the User related to PCPrivacyTool Sites/Services or with requests of information provided to or gathered by PCPrivacyTool with respect to such use.

Hard copies of this License Agreement and/or of any electronically transmitted notice shall be accepted in court or administrative proceedings related to this agreement, subject to the same conditions as other business documents originally created and kept in printed form.

Claims

Any dispute arising from your visit to PCPrivacyTool or to the purchase of products through PCPrivacyTool shall be submitted to confidential arbitration in the state of Nevada. In the event of any violation or threat to violate PCPrivacyTool’s intellectual property rights, PCPrivacyTool may claim an injunction or other appropriate remedy before any state or federal courts in the state of Nevada, which will have exclusive jurisdiction. Arbitration hereunder shall be carried out under the effective rules of the American Arbitration Association. The arbitrator's award shall be compulsory and may be recorded as a judgment in any competent court. To the fullest extent permitted by applicable law, no arbitration process under this Agreement shall be joined to another one involving a party hereto, whether through class arbitration proceedings or otherwise.
